Terms of service
These terms govern your use of nooknestly.com and any order you place with us. Please read them. By placing an order you accept them.
Who we are. Nook & Nest is a trading name of HOMART LIMITED, registered in England and Wales, company number 15257354, registered office 30 Uphall Road, Ilford, England, IG1 2JF. Contact: support@homartuk.com, 07868 375682.
1. The contract
Your order is an offer. A contract exists when we email to confirm despatch, or — for made-to-measure work — when we acknowledge your order in writing. The confirmation that follows checkout acknowledges receipt of your order, not acceptance of it. We may decline an order; if we do we refund you in full and tell you why.
2. Prices and errors
Prices are in pounds sterling and include VAT where applicable. Delivery is charged separately and shown at checkout. If an item is listed at an obviously wrong price we are not obliged to supply it at that price; we will contact you and you may confirm at the correct price or cancel for a full refund.
3. Dimensions and product information
Dimensions are nominal, to a tolerance of ±2mm on made-to-measure work and to normal manufacturing tolerance otherwise. We publish width, depth, height and the smallest cross-section for every item so you can check access, and our Will It Fit? guide explains how. Checking that an item fits your space and your access route is your responsibility — but we will check it for you free of charge if you send us the measurements before ordering, and we would much rather you did.
Photographs are illustrative. Timber grain and colour vary between pieces and screens reproduce colour differently.
4. Stated loads and stability
Where we state a shelf or top load it is a static, evenly distributed load on a level floor, correctly assembled. It makes no allowance for impact, for a person sitting or standing on the item, or for a child climbing it.
Tall storage furniture must be secured to the wall where there are children in the home, using the anti-tip fixings supplied or equivalent, regardless of any "freestanding" or "no drilling needed" label on this site. Those labels describe how a piece is designed to stand, not a safety exemption. Our renting page explains this in full. We accept no liability for injury or damage resulting from furniture that has not been secured where securing was advised.
5. Renting, fixings and permission
Where a product is labelled wall fixed, fixing it is a condition of safe use. If you rent, obtaining your landlord's permission before making any fixing, and making good afterwards, is your responsibility. We give general guidance on the renting page but it is information, not legal advice, and we accept no liability for deposit deductions or tenancy disputes.
6. Assembly and fixings
Most items are supplied flat with instructions and the fittings for assembly. Fixings for masonry, plasterboard, dot-and-dab or lath-and-plaster walls differ, and selecting the right fixing for your wall is a decision for whoever installs the item. We supply fixings suitable for common substrates only. If you are not sure what your wall is made of, ask a competent person before drilling. We are not electricians and any electrical work is for a qualified person under BS 7671.
7. Made-to-measure orders
Made-to-measure work is manufactured to the dimensions and specification you supply. Please check them. Changes are free until the date we tell you we are cutting; after that, changes are a new order. Made-to-measure goods are exempt from the 14-day cancellation right — see Returns & Refunds. Payment is 50% on order and the balance before despatch.
8. Cancellation and returns
Your rights are set out in full on Returns & Refunds, which forms part of these terms.
9. Delivery and risk
Delivery terms are on Delivery, which forms part of these terms. Risk passes to you on delivery; title passes when we have received payment in full. Delivery dates are estimates given in good faith. Where a delivery fails because the goods cannot be got into the building, a redelivery is chargeable.
10. Packages and multi-box orders
Packages, bundles and modular systems are supplied in several cartons and may arrive on different days. The despatch email states the number of parcels. A part-delivered order is not a failed delivery; tell us if a carton is more than 48 hours behind the rest and we will chase it.
11. Fire safety of upholstered items
Any upholstered seat pads, covers or cushions we supply comply with the Furniture and Furnishings (Fire) (Safety) Regulations 1988 as amended, and carry the required permanent label. If you fit your own fabric or foam to our frames, compliance for that material becomes your responsibility and you should not remove or obscure our labels.
12. Guarantee
We guarantee our own manufacture against defects in materials and workmanship for two years from delivery, in addition to and without affecting your statutory rights. It does not cover fair wear and tear, accidental damage, misuse, overloading beyond a stated figure, incorrect assembly or fixing, modification, or damage caused by damp.
13. Intellectual property
All content on this site — text, photography, guides and product descriptions — belongs to HOMART LIMITED or is used with permission. You may not reproduce it commercially without our written consent. Drawings and measurements you send us remain yours, and you confirm you have the right to give them to us.
14. Our liability
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, for breach of the terms implied by the Consumer Rights Act 2015, or for anything else that cannot lawfully be limited.
Subject to that: we are not liable for loss of profit, loss of business, or indirect or consequential loss, and our total liability in connection with an order is limited to the price paid for that order.
15. Data protection
We process personal data in accordance with our Privacy Policy, which forms part of these terms.
16. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts. If any provision is unenforceable, the rest stands.
17. Changes
We may amend these terms. The version in force is the one published here at the time you place your order.
